Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Eternal WeddingBells website and wedding invitation platform located at eternalweddingbells.com .

Please read these Terms carefully before using the Service. By creating an account or using any part of the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

You must be at least 18 years of age to create an account and use the Service. By agreeing to these Terms, you represent and warrant that you meet this requirement. If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

To access the dashboard and create invitations, you must register for an account using a valid email address and password. You are responsible for:

• Maintaining the confidentiality of your login credentials.
• All activity that occurs under your account, whether or not authorised by you.
• Notifying us immediately at support@eternalweddingbells.com if you suspect unauthorised access to your account.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or pose a risk to other users or the platform.

Free plan

You may create a complete wedding invitation, including adding events, uploading photos, customising your template, and managing a guest list entirely free of charge. The free plan allows unlimited previewing and editing. Your invitation will not be accessible to guests until you publish it.

Publish & Share (one-time payment)

To make your invitation publicly accessible and share it with guests, a one time fee of $5 USD is required. Upon successful payment:

• Your invitation is published at a unique URL.
• Guest RSVP functionality is activated.
• A QR code for printed stationery is generated.
• RSVP email notifications are enabled.
• The invitation is hosted for 12 months from the date of publication.

Payment is processed securely by Stripe. We do not store your card details. The $5 fee is non-refundable once your invitation has been published and made live, except where required by applicable consumer protection law.

Hosting period

Your published invitation will remain live and accessible to guests for 12 months from the publication date. After this period, the public URL will expire. Your account, content, and RSVP data will remain accessible in your dashboard. We may offer renewal options in the future; we will notify you by email before your invitation expires.

You agree to use the Service only for lawful purposes. You must not:

• Upload, post, or transmit content that is unlawful, defamatory, obscene, harassing, threatening, or otherwise objectionable.
• Infringe any intellectual property rights, including uploading photos or content you do not have the right to use.
• Use the Service to send unsolicited communications (spam) to guests or any other party.
• Attempt to gain unauthorised access to any part of the Service, our systems, or another user's account.
• Reverse-engineer, decompile, or disassemble any part of the Service.
• Use automated tools (bots, scrapers, crawlers) to access or collect data from the Service without our prior written consent.
• Resell, sublicense, or commercially exploit the Service or any content generated by it without our permission.
• Use the Service for any purpose other than creating and sharing personal wedding invitations.

We reserve the right to remove content and suspend accounts that violate these guidelines without notice.

You retain full ownership of the content you upload to the Service, including photos, text, and guest data (“Your Content”). By uploading content, you grant Eternal WeddingBells a limited, non-exclusive, royalty-free licence to store, display, and deliver Your Content solely for the purpose of operating and providing the Service to you and your guests.

You represent and warrant that:

• You own or have the necessary rights and permissions to use all content you upload.
• Your content does not violate any applicable law or infringe the rights of any third party.
• You have obtained any necessary consent from individuals (including guests) whose personal information you upload to the platform.

We do not claim any ownership over Your Content. We will not use your wedding photos, couple names, or invitation content for marketing or promotional purposes without your explicit consent.

When you upload a guest list or guests submit RSVPs through your invitation, that data is stored on your account. You are the data controller for your guests' personal information. You are responsible for:

• Ensuring you have a lawful basis for collecting and processing your guests' personal data.
• Informing your guests that their RSVP information will be collected and stored.
• Handling guest data in compliance with applicable privacy and data protection laws in your jurisdiction.

Eternal WeddingBells acts as a data processor on your behalf with respect to guest data. Our handling of that data is described in our Privacy Policy.

The Service, including its design, code, templates, graphics, and branding, is owned by Eternal WeddingBells and protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use the Eternal WeddingBells name, logo, or trademarks without our prior written consent.

The six invitation templates provided by the Service are licensed to you for personal use only to create and publish your own wedding invitation. You may not copy, redistribute, or use the template designs for commercial purposes.

We aim to keep the Service available at all times, but we do not guarantee uninterrupted access. We may:

• Perform scheduled or emergency maintenance that temporarily takes the Service offline.
• Modify, add, or remove features at any time, with reasonable notice where changes materially affect paid users.
• Discontinue the Service in its entirety, with at least 60 days' notice to active paid users, providing a reasonable opportunity to export your data.

We will make reasonable efforts to notify you of significant changes via email or an in-dashboard notice.

The Service is provided “as is” and “as available”, without warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be error-free, uninterrupted, or free of viruses or other harmful components, or that any defects will be corrected.

To the maximum extent permitted by applicable law, Eternal WeddingBells and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages including but not limited to loss of data, loss of revenue, or reputational harm arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages.

In no event shall our total cumulative liability to you for any claims arising under these Terms exceed the amount you have paid to us in the twelve months preceding the event giving rise to the claim, or $10 USD, whichever is greater.

You agree to indemnify, defend, and hold harmless Eternal WeddingBells and its team from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

• Your use of the Service in violation of these Terms.
• Content you upload or transmit through the Service.
• Your violation of any law or the rights of a third party.

You may delete your account at any time from the Settings page. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.

We may suspend or terminate your access to the Service immediately, without prior notice or liability, if you breach any provision of these Terms. Upon termination, your right to use the Service ceases immediately. If you have a live published invitation at the time of termination due to a breach, no refund of the publication fee will be issued.

We may revise these Terms from time to time. The updated version will be indicated by the “Last updated” date at the top of this page. For material changes, we will notify you by email at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service.
